ME Bank EveryDay Transaction Account $1,000 Prize Draw

  1. Information on how to enter, the prize and other details connected with this promotion form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.
  2. The promotion will commence 00.01 AEDST Tuesday 20 December 2011 and will end 23.59 AEDST Monday 30 January 2012 ("Promotion Period").
  3. Entry is open to Australian residents aged 18 years or older who complete and submit The Australian Workers' Union Census during the Promotion Period and validly complete their entry details.
  4. The Promoter is the AUSTRALIAN WORKERS UNION, trading as THE AUSTRALIAN WORKERS UNION NATIONAL OFFICE, with ABN: 28 853 022 982. Employees of the Promoter and their immediate families, agencies and people associated with the development of this promotion are ineligible to enter.
  5. Only one entry per person is permitted.
  6. The Prize for all states and territories except in the state of New South Wales is a $1,000 credited to an ME Bank EveryDay Transaction Account. The Prize for a winner in the State of New South Wales is an Adrenalin Voucher valued at $1,000. The Adrenalin Voucher is not redeemable or Transferable for cash.
  7. To redeem the Prize for a winner in all states and territories except the state of New South Wales, if the winner is not already an ME EveryDay Transaction Account holder, the winner must open an ME Bank EveryDay Transaction Account in their name within 28 days of that person giving notice they will be validly claiming the prize as the winning entrant, subject to standard account opening procedures. If the winner is an existing holder of an ME Bank EveryDay Transaction Account, the Prize will be credited to their existing account. If the winning entrant is an existing ME Bank EveryDay Transaction Account holder, the Prize will be credited to their account within 28 days of the winner notifying that they have such an account. If the winning entrant opened an account to redeem the Prize money, the Prize will be deposited into their account within 28 days of that account being opened.
  8. The Prize will be drawn at random by Mr Henry Armstrong of AUSTRALIAN WORKERS UNION on Tuesday 31 January 2012 at 12:00pm at Level 10 377-383 Sussex Street, Sydney, NSW, 2000. The first valid entry drawn, will win the Prize. The winner will be notified by phone and in writing on Tuesday 31 January 2012 and recurrent attempts by these methods will be made to notify the winner. The winner's name will be published in The Australian newspaper on Friday 3 February 2012.
  9. The Prize is not transferable or exchangeable.
  10. If the Prize is not claimed by 30 April 2012, the Prize shall be forfeited without any liability on the part of the Promoter to the winning entrant. In the case of the Prize not being claimed by this date, an unclaimed Prize draw will take place at Level 10 377-383 Sussex Street, Sydney, NSW, 2000, at 12:00pm on Tuesday 1 May 2012 and a new winner will be drawn at random by Mr Henry Armstrong of AUSTRALIAN WORKERS UNION, notified by phone and in writing and published in The Australian newspaper on Friday 4 May 2012.
  11. If this promotion is interfered with in any way or it is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  12. The Promoter's decision under Clause 10 will be final and no correspondence will be entered into.
  13. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  14. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of the Prize.
  15. Entrants' personal information may be disclosed to Australian State and Territory lottery departments and for publishing the winner's name as required under the relevant lottery legislation. In addition, the Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and service providers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
  16. The AUSTRALIAN WORKERS UNION complies with the Privacy Act 1988 (Cth) in collecting and managing your personal information.
  17. Members Equity Bank Pty Ltd ABN 56 070 887 679, AFSL 229500 ("ME Bank") is the provider of the Prize. Fees and charges may apply. Terms and conditions available on request.
